In this episode of Know Your Rights, I talk about Stop and ID laws. There are many myths and misconceptions about Stop and ID laws, so I hope this video clears it up for people.

The short version of what I talk about in the video is that the police must have reasonable, articulable suspicion to detain you. Only after being legally detained, are you at least required to give the police your name. But the Supreme Court has not said if you must give more information and the law can vary by state to state.

Oh. Also, thank you for my KYR cards. I keep one in my wallet and gave the others to close friends. That was awesome. Greatly appreciate that and that you actually did it. Must have has thousands of request and that's alot of damn stamps, envelopes, and cards that you paid for out of your pocket. Very impressed at your determination and drive to get the word out to people. I consistantly find that people have NO clue what their rights are and end up locked up over the simplest BS they could have avoided just by simply, knowing their rights!
Glad to know you're on our side! The police state still continues to grow stronger daily though, it seems.. sigh

Bro, two points; thank you very much for your service to the citizens of the U.S. We need more attorneys like you. Furthermore, your videos are not too long. If people complain it is on them. I would suggest they do as I do. Listen to your video while driving, fishing, hunting, working on your hobby, working in your garage, or doing housecleaning. It will make your longer videos much more enjoyable. These are very important constitutional lectures. No one should be complaining about their lengths anyway.

One time, years ago, I was picketing a road block. It was the first time I ever saw a roadblock in California, so it was a spontaneous picket. (I’m a teetotaler, but I love our constitutional rights, and I am libertarian when it comes to rights.) I went home and made a sign on a piece of cardboard, came back and stood on the sidewalk, picketing. I got a couple of fingers, yelling to get a life, etc, by motorists and an occasional honk or thumbs up of approval.

After a few minutes, a cop from the roadblock approached me and gave me the spiel about not blocking the sidewalk, etc. Then he said, “do you understand?” I replied with my name and address and added, “I’m going to remain silent, I want a lawyer.” I repeated three or more times exactly the same thing.” He then said, “You’ve been warned, ” and started walking off. I sort of mocked the cop with my name, address, and assertion of rights as he was walking off.”

I would not have identified myself except the cop already knew my name and where I lived, and it was too fun asserting my rights, no matter what the cop said.

Jay reminds me of Richard Glenn Boire, an attorney, who used to use the “Cops” show to analyze how they are violating the Constitution. This was before YouTube, or at least before I heard about YouTube.
