Litigation vs. Transactional Law

Also keep in mind that there's a good amount of dealmaking on the litigation side too. Most cases (95%+) end up settling and not going to trial, so negotiation still takes place in litigation but it's more adversarial than transactional negotiation. I hope this video was helpful in giving you a broad overview to these areas of law and how they work ! Unfortunately, it's very tough to get insight into what lawyers actually do until you're in law school.

If you have corrections/additional insight, please do weigh in on the comments. The goal of this channel is accuracy, but perfection is a moving target.

Have a video idea? Let me know in the comments!

I’m currently studying for the LSAT and have been thinking about both Litigation and Transactional for a while. This has been the most helpful, well thought out video on this so far. Thanks Julian!

I have practiced at both litigation and transactional law firms and agree with everything in this video. I also believe your law school and discussions with classmates can truly influence your decision on which one to practice... many classmates on law review going into litigation would comment that transactional attorneys are not real attorneys haha, but at least no one is up my day...well maybe a partner is

Do litigators also work in big law firms? Great video btw, I’m really loving the new content!

I am guessing AI will replace transactional lawyers before it replaces litigation lawyers (litigators).

AI might *assist* litigators, though.

Weird question, but in transactional law, do you ever deal with interest? For example, negotiating interest rates etc.

What does Harold know about law anyway?

I don’t know if anyone has told you this, but you look like a black-haired Harold Gunderson from Suits 😂

I largely agree with you except I would add some nuance to litigators needing to do lots of ‘legal research’. This is true if you’re in a big law firm handling complex cases; but if you’re in a small-mid sized firm handling some run-of-the-mill disputes (e.g. simple breach of contract for failing to repay monies owed), you don’t actually need to do much research if any.

Does anyone have experience with legal research in a continental law country? I imagine it would be very different from the research described in this video. But how exactly? I would like to know. Thanks

I appreciate your videos a lot, thanks. But I also feel it's my responsibility to tell you that you strongly resemble Uchiha Itachi. (Hopefully you get the reference).
