The legal definition of "eavesdropping" is when you listen in on a conversation, without the consent or knowledge of the parties to the conversation, and you either record it or use an amplifying device to hear what is said.

Under California Penal Code 632 PC, eavesdropping is a crime. It can be prosecuted as a misdemeanor or a felony and can carry up to several years in state prison.

In this video, a former prosecutor -- now a criminal defense lawyer -- explains California eavesdropping laws as found in Penal Code 632.

In California, If a family meeting is recorded at a private home without consent of some of the participants and the unassuming parties acknowledge on audio that another person who is not a participant in the meeting ( neighbor) is listening to their conversation, would that make the recording legal?

If you are one of the parties participating in the conversation and you're in a public setting, does recording the conversation without telling them become illegal
