Clarification regarding this video:
Under the new guidelines, petitioning the rent board in advance of a capital improvement rent increase is an acceptable method for the enhanced noticing requirements. It is not, however, the sole and only method by which you may be granted a capital improvement rent increase. In the alternative you may still provide the following to the resident: notice of the rent increase to the resident, the Rent Adjustment Program (RAP) notice to tenants, and a summary of the capital improvements (costs listed by category, date improvements were completed and paid for, and start and end date of the rent increase). The same documents you provide to the residents must also be filed with the Rent Adjustment Program within 10 days of service of notice. If the tenant contests the capital pass through rent increase, a hearing will be held.

Attention Oakland real estate investors, changes are coming to the Oakland rent ordinance. In particular, Capital Improvement passthroughs now require a petition to be filed with the rent board. If not done correctly, your increases could be invalidated and jeopardize future rent increases.
