What Is a Nuisance, First?

The words "nuisance" and "nocere," which mean to pain or annoy, are the roots of the English word "nuisance."
A nuisance is something that "works injury, discomfort, or damage," according to Blackstone.
A nuisance is an action or condition that interferes with someone's ability to use or enjoy their land, their ownership rights, or the general public's health, safety, or comfort. Nuisance, to put it simply, is an infringement on the right of a property owner to enjoy their possessions in peace and arises from an individual's improper use of their own property.

There are two Kinds of Nuisance
I) Public Nuisance, and
II) Private Nuisance

Public Nuisance
An unfair, unjustified, or illegal interference with a privilege accorded to the general public is referred to as a public nuisance. Simply said, a public nuisance is a conduct that affects the general public or a sizable portion of it and that interferes with rights that community members might otherwise be able to enjoy.

Private Nuisance
A private nuisance is one that infringes upon the rights of a particular individual or entity. A private nuisance, as opposed to a public one, affects a specific individual or individuals as opposed to the general public. A civil lawsuit for damages, an injunction, or both, rather than an indictment, is the appropriate course of action in a private nuisance action.
