My name is John Degasperis, I am a trial lawyer. My office is based out of Kingston, New York. I represent injured people. I probably represented more than 1500 injured clients over the course of my career. I understand how insurance companies work. I understand how the court system works and how to persuade juries.

Most of my cases are handled within the Hudson Valley although I do handle cases all over the state and throughout the country. I pride myself on my availability and I live and I breathe this work. When a client hires me I become obsessed with their story. I become obsessed with their case. My singular objective is to do well by them and to put them into a better place than when I found them. I know that being a lawyer requires empathy. I am a sounding board for people in their darkest hours and I become their voice. I am their advocate within a system that may not have their best interest at heart. A successful resolution is when a personal injury client feels as if the system worked and that I brought them to a place in the Civil Justice System, that gave them an opportunity to be made whole again.

A police officer ran a red light going over 70 mph in a 35mph without his sirens and hit and killed my family member of mine. When his spouse attempted to file a complaint with the department, police officer showed up at her door a couple days later add threatened that she could be arrested for making false complaints.
She was over 70 years old and they threatened her.

A few years ago an officer from Greenfield, MA going 83 in a 30 killed someone. Got 2 years in prison. Thats a slap on the wrist.

It’s called driving with due regard, and yes, laws regarding emergency driving (driving priority or driving code 3) drastically vary by state and driving with lights and sirens to calls is a pretty hot topic in the fire/EMS community for driving lights and sirens increases your risk for getting into a crash by over 400%. We’re trained to drive incredibly defensively and to be extra vigilant when going through intersections and heavy traffic, though this isn’t always successful.

Is it true that No emergency vehicle can go through the red lights of a school bus even if they’re responding to an emergency?

Man I know someone where a cop was responding to a call the cop was speeding to get there with no lights or sirens was said to be doing 80 in a 35 hit and killed a woman and nothing was ever done to the officer and the kids now grow up without a mom!!!
