The AI is going to play it overly cautious, since you're still supposed to be paying attention. Risky moves like moving outside the lane are going to be delegated to the driver, which makes sense because Tesla doesn't want to be sued for the AI being risky, they'd rather make you late than dead, which is appreciated.

The AI was probably expecting the car to move within the context of the cars position as it can't see if it has a driver or not. You can see it was originally going to move around it as it registered as a parked car but then as it moves closer it sees it is positioned in a way making it look like it is an active car.

Something my robotics teacher told me on high school that sticks with me to this day, "No matter how well you program or design something, you can never account for human error." Still, it's reassuring to know that if the AI is unsure if a vehicle is moving or not, it's default reaction is to come to a stop, as opposed to just plowing through traffic.
