What Happens if You Don’t Pay Child Support

If you don't pay, you're defying a court order, which is in fact a crime. It's also civilly actionable as contempt of court.

And if you incur a high enough debt, then it can also potentially constitute a felony of felony failure to pay child support.

So what happens to you if you don't pay? Well, the first thing that's probably going to happen to you is, if you have a DHS case open, DHS will begin to take collection action against you.

One of the things they like to do is they'll reduce arrearages to a judgment and do what's called a personal lien against you, which basically means they're going to file that judgment with the county clerk in the county where you live.

And that judgment then becomes a lien against all your property. Do you want to sell your house? You got to pay your child support first. Do you want to sell any other personal property?

That lien can attach and you may have to pay your child support out of the proceeds. They can take your tax return if you owe child support. If you get any other money like that, they can take it. You get a judgment in civil court, they can put a lien against that. They can garnish your wages.

At what point does not paying child support turn into a felony? I know someone who keeps quiting jobs so he could Dodge paying child support and the system is NOT doing anything

Not supporting your child is neglect and abuse. If I didn't support my kids I'd go to jail for abuse and neglect and they would end up in foster care.

One could argue that Title IV-D mandates could constitute involuntary (financial/debt) servitude and unjust enrichment. Compelling a father to pay under threats of garnishments and imprisonment could constitute Involuntary servitude…..a HUGE felony!!

In regards to not seeing your children if you don't pay child support. It is ILLEGAL for them to withhold visitation from you but your only recourse is to get an attorney and address the visitation order. Child Support and Visitation are two separate orders for a reason. Once a custody order is in place there is very little that can be done to alter it unless there is abuse. The judges aim for stability.

Challenge the order and Challenge the agreement and assert your constitutional rights. You only go to jail for debt if you fail to assert your rights. Slavery has been abolished. You have to fight them. There nothing but a debt collector. If the judge is not honoring his oath he took by honoring the constitution then go for his oath. Do not hire an Attorney your giving up your rights.

Child support is Unconstitutional 1997 Supreme Court/Court of appeals. It's an Executive branch that has nothing to do with Non-ivd title holders. Enforcement is for only their agents/employees and Uniformed persons. Everytime you all reply to their mail/verbally/signature give them the case number and Social Security # your Consenting to them. Tell them Creditors you wanna see proof you owe that debt. who sign title iv-d contracts have lost their judicial powers. Their independent. Read those letters carefully they sent you.. Does it have judge/Court checkmarked? Or something else? Child support has nothing to do with the families, it's written on their own words and former FOC Enforcement officers have spilled the beans on the whole Scammer system. Inside goods also👍. Cops/Deputy Sheriffs spilling their guts also. Modern day slavery/Organized Crime. It's all about the billions a year.. Quit consenting.. You all need to fight back and hit up that Constitution/bill of rights.. "LaW of The LanD" .. Remember now.. It's a Business Corporation "Executive Branch".. Not Constitutional/judicial.
