What do you do when a debt buyer files a motion to amend their complaint. How do you respond?

A viewer of mine shared his experience with a debt buyer lawsuit that I found interesting and I want to share it with you.

The debt buyer’s attorney apparently named the wrong company as the plaintiff.

That’s a huge error.

In a previous video, I pointed that out to you that you need to carefully look at the complaint and the attached exhibits to see if the plaintiff’s names match.

You’re looking to see if the company that’s suing you matches the name in the evidence.

When this kind of mistake is made by the debt buyer’s attorney, they’re going to try and correct the error.

I’m going to explain to you how a debt buyer files a motion to amend the complaint, and what you can do to respond by objecting to their motion.

I mentioned to PRA in my Answer that their purchase date did not match the exhibits. They waited 60 days to get me to stipulate an Ammended Complaint. I told them they would have to file a motion to get an Ammended Complaint so I could file an Opposition. We're waiting in a Covid-19 continuance in Oregon. Our hearing for the motion will be in June. The judicial economy was a good point. The rest I covered in my memorandum of authorities.

Robert, another informative video. Questions are State laws different on these procedures?

PRA filed a motion to compel my bank statements after I objected for the overly broad request on a joint bank account with my spouse. My goal is to hit back with a Motion to Compel of my own on a unredacted Forward Flow Account Purchase Agreement and to seek sanction on a overdue Request for Admissions.
