Let me rewrite the title properly: IS BREAKING AND ENTERING A PRIVATE PROPERTY A CRIME? YES

We don't have that problem in South Carolina. Nope.

When I bought and empty house ( it was inspected and waas empty) by the time I closed on the house, a person started sleeping on the floor. The day I closed I went to the house with my locksmith and the guy that was sleeping on the floor called 911 ! The P.D. trespassed the guy off the property; I was lucky. Subsequent trespassers - I had to hire an atty to get them off the property. Hiring an atty frees up time for the Police. When the papers have been signed by a judge, then the Police will post the Writ of Possession. So much less messy than getting shot at !

In many parts of the country, someone can break into a house, and it takes a year or more for the homeowner to get them out because it goes to the courts, where it takes so long for an eviction. The police can't do anything, particularly if the squatter can show that they have a utility in their name mailed to the house.

Sue the state. The state can’t grant rights over property it does not own, therefore; any “squatters right” the state recognizes is unconstitutional. It’s an illegal seizure aided by a state bureaucracy. In other words, tyranny..

I am not from the US and I really really really dont understand WTH is the logic that these people get into your private property and stay there for free. In all the countries I know that is absolutely illegal and you have 100% right to kick them out. I tought that was obvious. What is wrong with american laws ? this makes absolutely no sense.

Prosecutors and politicians play a critical role in these scams. Local authorities have done little to assist homeowners for a variety of reasons – from political calculations to negligence. Instead, they force landowners to go into overtaxed housing courts with notoriously slow dockets. It often takes months or years to get an eviction order.

The resulting lack of deterrence is evident in the brazen attitude of these criminals. A retiree friend of mine was away from her home is Sarasota, Florida, when a squatter moved in and refused to leave. The woman falsely claimed that she had a lease and trashed the home. Eventually, she was arrested but promptly released. She then returned and stole my friend's car. The police said there was likely little that would happen to the squatter.

Get a “Intruder Affidavit”. Saw that work immediately.

We had that happened to us. I was angry but was told it's a civil matter. They were not able to help. The law has to CHANGE. Hard working people work for years to obtain their properties. Then the squatters show up. What kind of justice is this? 😡

I can’t believe how much protection these people have. I’m actually an equal exchange house sitter. I’d be more than willing to house sit for anyone who is looking to avoid being taken advantage of by squatters. There would be no out of pocket cost as long as basic utilities are available.

it should not take a court to confirm who is the real owner of the house and no more than a day to resolve it and to get rid of an intruder.

If you are getting ready to leave and don't want this to happen. Make sure that your realtor or property manager includes temporary residents with required times to be out by. I know some college kids that offer this service through a company and keep a place to stay year round. They are bonded for housing services. Some people leave some very large excellent properties as they go overseas to fulfill business or other contracts.

Lawyers intentionally work to make sure its as hard and complicated as possible, why? Because as middle men, they make a massive profit off of the process. They are not out to make a perfect system, rather they want to force their over paid relevance every step of the way, and then drag it out.

A better question: why in the (formally) wealthiest nation on earth do we have so many homeless people and why won't the government do anything to help them instead of just starting them over and over again?

I just found a bunch of dead people in my home. Oh well

So force them on the streets. It's not just druggies that are squatters sometimes it's just homeless people not wanting to be out in open when they sleep in a society that treats them worst then stray animals
