DWI Checkpoint? Turn Around! #lawyerreacts #police

If you are coming up to a DWI checkpoint... TURN AROUND. You might be completely sober, but the cops are looking for any little thing to take you down to the station. Be sure not to break any traffic laws when you turn around, and be sure a cop isn't trailing you to see if you make any minor violation so they can pull you over.

You also need to know that at a checkpoint, you are legally being detained. However, you can still invoke your Fifth Amendment right to remain silent and say you will be happy to speak with the cops when your attorney is present. Often times, the cops just want to push through the long line, so they usually let people go unless they reek of alcohol or have alcohol in plain view.

I've read of DWI cps where the cops used the fact that someone turned around as "probable cause" that they were drinking and followed up with searches, breathalyzers, etc.

They deliberately make the requisite detour option confusing, & they park next to it as a menacing posturing. The Badged-Brethren R.I.C.O. is NOT your friend

How is that not an illegal detainment? "OUR" supreme court sure like to play fast and lose with OUR rights!

A few of those states REQUIRE that the cops clearly announce they there is a checkpoint ahead AND provide a "last chance exit" to avoid it. BUT...
If cops SEE you do a U-turn or use that "last chance" exit, they will often have cops detailed to chase down and detain those cars anyway. Because AVOIDING a checkpoint is seen as "reasonable suspicion" that you ARE driving impaired.

They did this in Texas a while back, coming out of Dallas. I feel so bad for people with poor eyesight. I was warned ahead of time, saw the flashing lights a ways up, and hit the feeder road for my entire trip. One-eyed it the whole way through😂

A common tactics is to put up barricades so you can't "legally turn around, and not post a sign for several hundred feet past where the barricades began.

I miss those checkpoints way back when. In my state a lawsuit brought before the state supreme court, they ruled them unconstitutional. Full disclosure here I’m a gear head - hot rodder. I used to love rolling up to a check point in my built big block Chrysler 😂😂😂, loud exhaust on Friday night., I always carried spare light bulbs and screwdrivers . Made sure everything was working 😂😂👍. I kinda miss them, ha, ha. The only issue for me was my loud exhaust and it was loud 😂😂👍. The cop tried to give me bullshit about once that it was loud and illegal. I informed him it was legal and I worked for the state department of environmental quality. So write me a noise ticket. That’s all he could do. Then I’d take the car to a vehicle test station and have them do a noise test, it would pass then they would write a noise compliance certificate then I’d take to court with me. Needless to say that ended that conversation 😂😂😂, as the big block magnum was idling😂😂😂👍. I had so much fun on the weekends at those check points. I’d drive around just looking for them. Nothing like rolling through a checkpoint with the engine idling at 1, 100rpm 😂😂😂👍👍😎😎 if forget something. Just to kinda rub salt in to the wound in my rear windows both sides I had Chrysler direct connection Chrysler Powered race stickers on both sides😂😂😂👍👍😎.. I miss those days . Had a lot of fun in that car. Especially one morning I did a totally awesome 3 lane change hole shot onto the freeway at 6.30am in front of 2 state highway patrol officers 🤪🤪😂😂😂👍. And PS the 13 inch cherry bomb glass pack mufflers were totally blown out and the car was extremely loud. I got pulled over of course. The cops let me go and I still made it to work 3 minutes before the 7am bell😃😃👍.

Iv seen cops pull over c.p. u-turners. If a bunch u-turn, they all can't be stopped. Sometimes there's a c.p. in both directions.

Can you safely legally stop and wait for them to leave if you have the time? Or turn into a driveway?

What about the officer who follows you if you turn around for suspicion? Is it a justified suspicion?

Am I being detained over a misdemeanor or a felony? What crime did I commit in order to be detained?
