Car driver nearly hits delivery rider

The delivery rider was distracted by their mobile phone and had swerved into the right lane. Meanwhile the driver recklessly decided to pass them despite of this. Arguably both would be collectively at fault if they were to collide but who do you think would have been most to blame?

90% bikers fault for drifting over without checking though the car had time to hold back but looked like they wanted to make a point imo.
