Показать описание
In today’s video I plan on discussing the sponsor license, what is it?
Why is it important? And how can your business obtain a sponsor license to allow foreign skilled candidates to join your workforce?
While I am no fan of Brexit - it has created a wonderful opportunity for people to recruit from around the world - and the first step to it is getting a Sponsor Licence.
While this might sound daunting or too much like hard work - the process is really quite simple and we can help.
We can help with not only getting but helping you maintain your sponsor licence.
So if you are running a business and want to know more give us a call and we can discuss your needs.
In the rest of this video I am going to be outlining just how simple the process is and how easy it can be.
Having a sponsor license is a key requirement if you intend on sponsoring migrant workers or students to join your business in the UK.
The Home Office will determine whether your organisation is eligible for a sponsor license by assessing whether you can meet key criteria. Specifically, you must be able to show that:
1. Your organization is genuine, operating lawfully and is based in the UK. In addition, you will need to provide full details of the premises and where any sponsored workers would be working.
2. You have appointed key personnel who will have specific roles for the duration of the license. In particular, you will need to appoint an:
a. Authorising Officer (who will be the most senior person in the organization);
a. Key Contact (who will act as the point of contact between the Home Office and your business);
a. Level 1 User (who will be responsible for carrying out day-to-day activities on the Sponsorship Management System (SMS));
a. Level 2 User (who will have less permissions than a Level 1 user)
3. You can effectively manage your sponsorship duties, through the use of Human Resource systems and practices, including the training of key personnel to ensure you are able to fully comply with your sponsorship duties.
4. The roles you are recruiting for are genuine and meet the relevant skill and pay level for the specific visa route.
To demonstrate this key information about your organisation, you will need to provide documents as set out in the Home Office’s published guidance titled ‘Sponsor guidance Appendix A’ – published on 14 April 2023.
The guidance is divided into 4 main tables. Each table lists the documents you must provide, depending on your type of organisation:
1. Table 1 – documents specific to certain bodies and organisations;
1. Table 2 – documents specific to start-ups, franchises, charities and organisations subject to regulation or inspection;
1. Table 3 – required documents for specific routes; and
1. Table 4 – other required documents;
The best way to approach this guidance and identify which documents YOUR organisation needs to provide is to read all of the tables in full starting with Table 1.
It is important to remember that you must provide a minimum of four documents (or where stated, four combinations of documents) from the Appendix alongside the submission sheet which should be signed by the Authorising Officer.
All of the above we can help you with - we have been doing this for years - as I mentioned above it is only after Brexit and the Pandemic that it has become clear how much of an opportunity a Sponsor Licence provides.
