Kuzan always has a reason for his actions. If there is one person more calculated that BB, it’s Kuzan. He saved Nico Robin not because she was a child, but because he knows how corrupt the World Gov is, as well as how corrupt so many pirates can be. Also he didn’t want to become the fleet admiral because as we have seen he’s lazy af and that job doesn’t suit him at all. What if Law is secretly working for sword and based on koby kidnapping, law chosen the direction towards BB might be and he has already planned everything out with the help of Drake and nevy admirals ( fujitora or any other ) already on the way to backup Law that's why Law is so confident. Remember that this is happening after probably 1 or 2 weeks after kid, law and luffy left Wano and kuzan would save koby/pudding to ruin BB's plan or may be he might die ( I don't really think BB won't do harm to nevy also and Nevy also need to take some damage at some point because many new admirals are already recruited)__

I believe Kuzan isn't a spy or anything but sincerely a crewmate of BB. The reason for that is simple, BB is very intelligent and seem to know much more than everyone else about devil fruits and the OP world in general, dude was the only person in history to be able to wield 2 DF at the same time, he is the only one confirmed so far to be able to steal others df and give them to his crewmates, he also knows about xebec which is supposed to be deleted history that no one but a very few people in OP know about and he also has some kind of DF book that has every DF recorded in it.

He most likely told Kuzan a little about the WG, the celestial dragons, his dream, Imu sitting on the throne, what xebec was trying to achieve, etc which convinced Kuzan to join him.

Plus BB is probably the smartest character in OP, there is no way he would have let Kuzan join his crew if he wasn't positive that he wasn't a spy, as for why Kuzan isn't a commander maybe he is the one who rejected the offer or BB simply has other plans for him since Kuzan be travelling a lot.
