As vice president she is technically a member of the executive branch. However, under the Constitution, she has a limited role to preside as the president of the senate and she gets to vote only in a situation where there is a 50/50 tie. It is one of the unique features in the Constitution where there is a slight overlap between the executive and legislative branches. Another example is in the situation where a president can propose bills for the Congress to consider. However, while the president in this example is "writing law, " the passage of the law is the exclusive province of the Congress. A third example is during impeachment when the Congress (the writers of law) assumes the role of the judiciary when they conduct trials. In the case of a trial for the impeachment of the president, the chief Justice of the Supreme Court presides over the impeachment trial. Thus, there are many examples where the traditional roles of the individual branches of government overlap each other.
