According to the rules for the Speical Counsel, a sealed indictment would have to be approved by Rod Rosenstein. Hopefully, they have already done that. It doesn't matter if anyone thinks Comey should have been fired for his handling of the email investigation because Trump said he fired Comey because of the Russian investigation. Rosenstein appointed a special counsel because AG Sessions had to recuse himself.
