In this part of our series on the Board of Veterans’ Appeals, we are examining the Board’s alarming remand rate and what it means for veterans. The Board may remand a claim if the record is not complete for the Board to make a fully informed or favorable decision. As of July 2023, the BVA's remand rate is nearly 50% of decisions issued for Legacy VA Appeals, some of the oldest appeals in VA's system.

A high remand rate means Veterans must wait longer for a final VA decision. CCK believes that Veterans deserve a timely decision from VA.

This is why I’ve been warning people not to join. The disrespect us veterans experience after serving this country; especially, us combat veterans is beyond disgusting.

A new law needs to be passed where the VA has 6 months to decide on a claim and if they do not meet the timeline the claim is automatically APPROVED with No further exams or other VA tricks to rob the Veteran!

My legacy Appeal has been remanded 3 times. Each time the board approves part then sends the rest back for remand then we start over. My last one is at the regional office now. Let’s see what happens.

13 years in appeal. 3 years in remand. I am 80 and at the "top of the list" for the past 5 years. Must be one hellova list.

Took 15 years for me to get VA benefits. I originally received 40%. Then two years later, I was granted 100%.

I had my appeal by the BVA remanded to Texas and the claim originated in Florida. It took 5 months for Texas to deny the remand. The denial was for Sinusitis, The original BVA appeal was filed in 2019. My military records show a diagnosis of Sinusitis. I can't understand why the claim was denied. In my case and for other veterans as well, a remand is a denial. Why does the VA take so long to review your case, when they already know that they're going to deny it?

My direct review will be 3 y/o in Oct. Gosh, I guess I'll be dead when it's all said and done.

I filed a claim in 2016 was denied in 2019 and had to appeal. It was shocking to my VET Rep and therapist because I am a combat veteran. I appealed but did not hear anything, even with a representative checking monthly, until July 2023 where I received a decision. The judge remanded my claim and basically said there wasn't a good reason to have denied me. I went through a new C&P exam in August 2023 and then in October 2023 my Rep sent me an update with new information. The claim was ready for a decision but has not been returned to the Board of Veteran's Appeals. It is now almost February of 2024. I am starting to think I will be dead before a decision is made.

What you neglected to explain is that when a Claim is Remanded under Joint Remand from/between CAVC/VA/BVA, it has specific Timelines Period!

Its not even worth it. If you cant get them to approve your initial claim and claim with HLR or a supplemental, its time to move on with your life.

I hear different things with these lawyers, I got a Remand letter about a month ago with one granted claim, and for future development of other claims, my claim started in the legacy and appears to be on a fast track, VA do what they want and their is no exact time on getting claim decisions...just keep pushing for what belongs to you and the VA will grant you if your claim is correct and the regional office does the right thing by looking at all evidence submitted.
