It's not a War because the opposing army is not recognized as "lawful combatants", Luhansk and Donetsk are treated as separate Nations and the attack on Kiev is to pressure Zelenskyy to release these areas, which ( as of now ) also includes Mariupol. Once Ukraine has been divided according to Kremlin, any further attacks will be classified as a War.
