RG Kar Case Verdict: Judge Reveals Reason Behind No Death Penalty For Sanjay Roy | Kolkata Doctor

West Bengal's Sealdah court awarded life imprisonment to Sanjay Roy in Kolkata doctor case. Court rejected the prosecution's plea for death penalty. It held that the case does not meet the 'rarest of the rare' criteria necessary for capital punishment. Additional district and sessions judge Anirban Das of the Sealdah court stated...

"In the realm of modern justice, we must rise above the primitive instinct of 'an eye for an eye' or 'a life for a life'. Our duty is not to match brutality but to elevate humanity through wisdom, compassion, and a deeper understanding of justice.": Judge Anirban Das

The judge emphasised that a civilized society is measured by its capacity to reform rather than exact revenge. He pointed out that Supreme Court has consistently underscored that death penalty should be reserved for cases where the community's collective conscience is profoundly shocked.

Shame on the judiciary.. This only encourages the criminals to commit more such crimes.the fear of punishment and justice is lost in India. He will be granted bail after few days and will leave curseing India to enjoy his life in a best way.

Wow. Seriously? They have the guts to say that this was not the "rarest of the rare" case? What kind of a case can be sufficiently horrifying to the Indian judiciary, if not this? All these months of trial and we could still not give the poor girl her justice. Shame on my country.

The court knows this Sanjay is not the real culprit, so did not hand the death penalty. The real criminals are still at large and shielded by Kolkata police, CBI and Mamta government.

Then why was the kerala girl who killed her boyfriend given death sentence but
For rape and murder no death sentence. Baffling justice

By stating that this is not the "rarest of the rarest" cases, the indian judiciary has actually admitted that such horrific crimes are the norm in the india and that we have indeed devolved into such a pathetic society.

Exactly, what I wanted to ask. If the same thing happens to her daughter/sister/wife/mother can he elevate humanity through wisdom, compassion and deeper understanding of justice?

Why compassion for the cruel and not for the victim?

Death penalty for a serious crime is not revenge. It is another form of justice being carried out.

THIS JUDGE MUST ALSO BE SENTENCED TO LIFE IMPRISONMENT, TO BE WITH sanjay roy.
INDIAN JUDICIARY IS PRACTICALLY BECOMING A SANITORIUM.

Mr Das would you do the same if it was your daughter, according to what you say means it is okay you are human, which is more encouraging than trying to stop

How come the judge in Kerala did not follow this for the greeshma-Sharon case..

There is no consistency in the Indian judicial system. It is so subjective rather than being objective.

And which judge is correct now? Will the SC intervene?

These kind of judgements will increase the crimes. There will be no fear factor. Shame on these kind of explanations. Judiciary is completely supporting crimes. Thousands of Sanjay roys are already in our society and will get multiplied in future. These judges are making our girls' lives horrible.
