What you do to sue them for a godly amount of money is take a fresh can open it without damaging the actual can and break off a piece of that plastic. Call 911 and say you just choked even tho you didn't and then go to hospital tell them the same story that you choked on a piece of plastic and go home. Now you have a police report of incident and medical records for an easy win.
