"realtively clear" the 14th amendment was not always interpreted the way it currently is. Birth right citizenship seems to have been granted by an agency with no decision by a judge or change in law. The 14th says "and subject to the jurisdiction of" clearly anyone present in a country is subject to that countrys laws, so it goes without saying. The reference was to nationality, non citizens being subject to the jurisdictions of thier relative countries.
