Actually I do think they will have success in their lawsuit against the SEC. The prosecution team will present the 99% of 11400 investor letters that were positive on GBTC being converted to the first Bitcoin ETF. A judge will see there is liquidity in GBTC and that the actual Bitcoin is there to have a successful ETF for investors to put their fiat in. He will rule that the SEC has no good reasons to deny the application and will rule in favor of forcing the SEC to approve the first Bitcoin spot ETF. JMHO; I was one of the 11400 investors in GBTC who did write a letter to the SEC giving reasons why they should approve it.
