You can file for adjustment of status as a spouse of green card holder if the F2A filing date is current but the F2A final action date is not. You have to file both the I-130 and I-485 at the same time (so-called “concurrent filing”), before your visitor status expires (in the 90–180 days window after arrival). Once you filed and your visitor status expires USCIS will not count the gap against you when determining if you maintained status.

I-485 (Application to Register Permanent Residence or Adjust Status)

I-130 (Petition for Alien Relative)
I-130a( goes with 1-130)

I-864 (Affidavit of support)

I-765( Application for Employment Authorization)

What about petitioning for your child? I'm a US Citizen and had a child (in wedlock but now divorced to non us citizen). My 8 year old is in the states with me on a B1/ B2 visitor visa. She was born abroad. How easy would it be to get her status adjusted so she can stay in the states with me and get permanent residency?

Good Morning Sir, I just have a question. My father is in the Philippines right now and I am a US Citizen and I petitioned him to come here as an immigrant, the timeline right now is a little over a year. He has an existing 10 year multiple entry visa and have used it several times the past years. My question is, can he come here in the US using his existing tourist visa and will just wait for his petition to be approved here in the US?

Hi, i wanted to ask that if i have a B1/B2 Visit Visa approved before which is valid for 5 years and then submit my i-140 petition for EB-2 NIW Green Card from outside USA and if my i-140 petition gets approved also

Then can i enter the USA when my priority date becomes current with my still valid Visit Visa and do the process of Adjustment of Status?

And do i have still wait for 3 months to do this? Or can i do it instantly? Please do answer.

If i come usa on visitor visa and apply EB3 unskilled process and go back to my home country pakistan ... my EB3 unskilled process continue in my absence in usa and after completing my EB3 unskilled process i join my job, employer in usa and get green card
