I can also add; Do not, under any circumstances, talk to any medical personnel that you may encounter if you are placed in custody. Most EMTs and nurses love to tell the police anything that you say.

I told the police, "I would like to have an attorney present for questioning". This video is good so if I have unwanted police encounters in the future, I will say, "I am asserting my right to remain silent. I am am asserting my right to counsel. I do not wish to answer any questions at this or any other time. Thanks for making this video so we can improve what I need to say.

So the guy remained silent for 3 hours and then just anwered one question and the Supreme Court judged he waived his right to remain silent just because of that. Technically right but morally insane.

Remember, when they question you, all they're trying to do is take the burden of proof off of themselves and hope you'll inadvertently incriminate yourself with their loaded questioning, thus saving them the bother of investigating any further. Chances are, at the time of questioning, they have no proof whatsoever. Every question they ask will assume guilt on your part, however you answer.

I think I would just say, "I assert my Constitutionally protected right to remain silent, " and then not say anything else. I've heard one of the constitutional auditors on YT, SRV (check him out), and he just says "I don't answer any questions." If you don't want a police encounter to be "consensual, " tell the cop that you don't want to talk to him and would he please go away. They act like they want to know how your day is going, who you're hanging around with, where you live and on and on and on. You don't even have to give them ID unless you're under arrest or suspected of committing a crime. They want to get into all of your business, and search your car too.

We had a case locally where the person arrested asked for a lawyer multiple times and they continued to question him. After several hours they extracted a confession. His lawyer got the confession thrown out and all evidence from the confession.

Nothing good ever comes from talking to the police. Don't talk to them, don't answer the door to them. If they have a warrant, they will open it for you. And keep your mouth shut!!!

Under the 5th amendment to the US constitution I don't answer questions
Under Maranda, I have the right to remain silent and want my attorney present during questioning
Under the 4th amendment to the US constitution I do not consent to searches
Am i free to go or being illegally detained

For citizens in California - The California Supreme Court has recently ruled that the act of remaining silent can be used as evidence against you at trial. This was for a case in which a driver that killed 2 people in an accident did not ask about the status of the victims after the crash.  His silence helped to convict him.  

This is the twisted mentality of the justices of this once golden state.

It is really twisted, since in logic this is breaking silence. This is great information, the difference between having this and not having this is overwhelming.

The correct reply is.... "I respectfully refuse to answer any questions." Keep repeating that phrase...
