Isn't that the falacy in "a defendant who represents himself has a fool for a client"? When the laws are written in such complicated language and adjudicated in their edified institutional beaurocratic systems, justice is at the mercy of the same system. For this reason, lawyers pretend to be our only "smart qualified saviors" in the courts of justice. That is bullshit! I've known a few extremely dumb and unqualified lawyers in my life as a social worker and community activist. And the corruption and abuses of the criminal and civil justice system are well documented, all the way to todays federalist corrupt MAGA supreme court. That's why after a couple of traffic and one misdeameanor convictions, in which I was not guilty of neither, I've learned to defend myself! I live and drive "while mexican", so I'm in constant threat of police corruption and abuse. I'm proud to say that I'm 0-2 when defending myself in court as of late. And here is what I know:
1). Try if you must to avoid interacting with any pig law enforcement agency, and try to obay all laws all the time.
2). Know your rights and the criminal and civil court proceedings, and their codes.
3). Your defense begins when the pigs detain you, legally or otherwise, and anything, "anybody" says may be admissible in a court of law!
4). Never trust the pigs, they are not your friends! And remember that they can lie, plant evidence, threaten you or any witnesses, and write false statements. You must remember that the pigs are protected for their "unlawful but lawful" behaviors until they are sworn in a hearing or trial. They relay on "here say" (police reports) to get the DA to bite you ass and drag you into a court even if you are innocent!
5). Never plea guilty to any crimes, demand evidenciary hearings so as to put the pigs under oath and insulate your case from the abuses of district attorneys. This also gives your lawyer (public defender or private) evidenciary support for your defense.
6). Never trust a lawyer! Not even your own public defenders or private attorneys, deputy district attorneys, judges, or court clercks. Remember that in this criminal and civil justice system, you'll get whay you pay for, and ignorance is not a defense for you...thats your last nail coffin!
7). Always ask for a speedy jury trial and never wave any of your rights without thinking about the consequences of your actions!
8). Publuc defenders and your private lawyers are lazy, overworked, synical, racist, and greedy! If you can, come up with any and all evidence that you can gather on your own, even written affidavits, will help some where along the process. Yes, even 40 years after a wronful conviction.
8). If you chose to defend yourself, you must understand the penal and civil codes and crimes you are being charged with, know case law, and court rules.
9). You can fire most of your lawyers if the judge allows it. In any case, you should retain your defense lawyers as council beacuse that's one of the many advantages of the system you can afford. Filing and arguing motions is not our stenght. So use the system against itself!
10). Before hiring a lawyer, even your public defenders, investigate them! They all have a "Bar" license number and code which has a history of their judicial conduct...or misconduct. ALWAYS REMEMBER THAT YOU ARE THE BOSS OF YOUR OWN DEFENSE! You must insist that you are retaining them assholes (including public defenders) for your aquital or best legal outcome in your case.
