First of all, I'm so sorry for your loss. The general rule is that when an I-130 petitioner dies, the petition dies with them. However, there are some situations where the petition can be saved. If you require assistance with an immigration matter, please feel free to contact my office to schedule a consultation with me so that I can help solve your immigration problem.

If the beneficiary is working in a cruise ship - the Royal Caribbean for over 10 years, whose many assigned destinations were in the USA, can that be considered having resided in the US while working in the cruise ship?

After the death of the petitioner in the approved case in F3 CATEGORY,

Hello, Atty Darian. I would like to ask for your humble assistance in regards to the case of my father. When my grandfather was still alive, he was about to petition my father and us, his family, to come to the US. However, while the case was still ongoing at that time, the US immigration officer advised them that my grandfather should be presently living in the USA by that time, or if not, could provide them with a photo of my grandfather while he was in the USA. My father couldn't provide a photo of my grandfather at that time, and my grandfather could no longer travel back to the US at that time. Unfortunately, my grandfather died. I am just wondering if my father could still reinstate the case even if he is here in the Philippines and never been to the US. However, he still has his aunt and uncle there in the USA. Thank you so much!

Hello Sir,
I need your opinion on the following scenario;
My I-130 - F2B petition approved 2006 before my mother died in 2008.
My US citizen father applied for humanitarian reinatatement while I am in Usa on work visa (legally). The case got reopened however a while back I received NOIR saying while I satisfied all the requirement but I am not eligible for relief since I am married now and the original petition was for unmarried child. I already responded but what do you think the chances of humanitarian reinstatement now?
Thanks
