Washington Gun Law President, William Kirk, discusses the huge news out of the United States Supreme Court that they have accepted review of === a case which will call into question the future of the Chevron Deference, a tool used by administrative agencies throughout, including the ATF, to arbitrarily enforce the law depending on which ways the political winds are blowing. while this certainly can hinder the ATF, the reality is that the Chevron Deference is inapplicable to most, if not all, enforcement efforts. And today, Chevron Deference is done. ATF has been put in their place so many times, but the times, they are changing.

Imagine if the Republicans didn't have the upper hand in the Supreme Court. That position should have no party affiliation, but it does. I hope they find all the overreach of these agencies going on and put an end to it, or an end to all of those tyrannical agencies who also shouldn't have any party affiliation, but they do too.

Forgive me if I have little faith that anything positive will happen. Even if it ends up being a favorable decision, I have little faith that the various agencies will head it and comply in any way shape or form.

IMO,
Shouldn’t even need the court to take back the authority and reign in these out of control agencies.
Congress should have stones to simply say
“sorry kids, you’ve overstepped your authority. An authority that belongs to us. Now go do the jobs you’re supposed to be doing.”

This here is why I subscribe to this channel. I watched another channels post and it took them over 30 minutes to explain this!! My eyes started to glaze over!! Mr. Kirk thank you for explaining this so plainly (and in less then 10 minutes!)

Even police and lawyers don’t know all of the gun laws yet us “owners of this country” are required to know all of the gun laws or we could lose our freedoms and possibly our families while we are in prison. Wonderful system 😡😡

Still waiting on that magazine capacity ruling from the judge in Eastern WA, is someone threatening her life? And what the heck is taking Roger Benitez so long to issue a ruling from San Diego? Is he also being threatened?

Only issue I see is that the ATF hasn't been using Chevron as a defense in quite some time... probably because they saw SCOTUS leaning away from it, signaling they'd likely overturn it. That said, hopefully the court sees that they have no other reasonable law nor precedent to back their behavior, recent rule-making in particular.

I was a Bering Sea fisherman for a long time. We have had those fish observers since the early 90s. We always had to pay for them. This is nothing new.

NMFS could be the poster child for government overreach. It is good that they are finally being taken to task.
