My father has 3 brothers and 3 Sisters and I am living in my Grandparent' property by birth. The eldest brother of my father cheated on my Grandmother and signed a Will from her when she was alive. After that my uncle divided that property among all these brothers.
Do I have Coparcenary rights in this property now? Which is the Case Law for reference?

सर यदि किसी व्यक्ति के दादा के पास लगभग 40 बीघा कृषि भूमि थी, दादा की मृत्यु के बाद वह भूमि भूमि उस व्यक्ति के पिता को प्राप्त हुई थी और अब पिता की भी मृत्यु हो चुकी है। और वह भूमि अब उस व्यक्ति के नाम पर दर्ज हो चुकी है। वह व्यक्ति 40 बीघा भूमि मे से 7 बीघा भूमि अपने परिचित को गिफ्ट देना चाहता है। तो क्या विरासत मे प्राप्त भूमि को गिफ्ट कर सकते है। या नही ?

मेरे दादा की जमीन 1947 के पहले थी ।जब भारत आजाद हुआ तब मेरे दादा की उम्र कम होने के कारण मेरे दादा 1952 में जो जमीन का रिकॉर्ड त्यार किया उसमे अपना नाम नही लिखवाया ।और अब वो जमीन सरकारी जमीन में ही क्या उस जमीन को हम वापस ले सकते ही।
1. उस जमीन का हमारे पास नवाब को जो मेहसुल देते थे उसका 1909से 1924 तक की रसीद ही ।
2.जिला जमीन निर्क्सक की ऑफिस लाया हुआ नवाब साहब का 1933 का रिकॉड ही जिसमे मेरे दादा और पिताजी का नाम और जमीन ही ।क्या ये जमीन हम वापस मिल सकती है ।क्या हम कोर्ट में कसकते ही।
