They can't speak to his activity, but they can speak to her activity. Specifically, Harvey could go on the stand and his lawyer could ask why the secretary was fired. Harvey could say that she was sleeping with a partner, the partner was embezzling, she was aware of the embezzlement, and she didn't report the embezzlement.

At that point Harvey's lawyer can ask him to name the partner. Harvey can inform the judge they have a confidentiality agreement regarding the partners activities. The judge will say that they don't care and to answer the question, because a court can compel you to, and in that scenario it isn't a violation of the agreement anymore.

Then Harvey would tell all about Hardman's embezzlement, and he couldn't stop it or sue later.

there is a EASY way out of that Clause. Fire harvy before his Court Case. If he is NOT currently Under employment, then the agreement made by The Law Office is NOT BUINDING to him because He didnt sign, and neither is he Employed by said company regardless of if his name is a part of the company.
