Missouri AG issues ultimatum to Gardner: Resign or be removed from office

Amid mounting calls for the St. Louis Circuit Attorney to resign, the Missouri Attorney General has issued an ultimatum for Kim Gardner: resign or face removal.

What an interesting development in this Kim Gardner Saga.
From a sympathetic "60 Minutes" story, to a pariah in the community. It's like watching Paula Deene's decline.

Ms. Gardner is clearly flailing. The victim was a child, Black, and a tourist. This guy had no business in 2023 still awaiting trial for a crime he was arrested for in 2020...the jury didn't let him go, he was still waiting to just to even go to trial. And when she couldn't even schedule an attorney in her office to show up at his trial, the judge had to drop the charges.

And how many times did Kim Gardner NOT have one of her attorney's show up at a scheduled trial? Once? Twice?


Didn't one of her attorneys *who was out on Maternity Leave* miss a murder trial date? Why wasn't another attorney scheduled in her place? Or, how could the public believe that Kim Gardner's office had even prepared a case against the accused defendant if the prosecutor that was assigned wasn't even in the office due her Maternity Leave?

(and why did that same attorney quit, apparently in disgust, after it was revealed that her signature was placed electronically on several court documents while she was away on Maternity Leave? Was her signature forged by her coworkers? Is that a common practice in Kim Gardner's office? How many people did her office put into jail or prison with a forged signature on their paperwork, paperwork that implies the courts' requirements had been met?)

Ms. Gardner's new, revised statement released today, where she apologizes to the victim, should have been her first statement released. It is interesting that in her first statement, Ms. Gardner says there should be no "finger-pointing." Yet, in her new statement she details several instances that she says the Judge allowed this defendant to remain out of jail. Clearly, her finger is pointed at someone.

It is now 9:30AM, and the Attorney General of Missouri has given her until 12noon to resign. In the meantime, a young girl sits in a hospital bed with both her legs amputated.
Kim Gardner has fallen a long way since that 60 Minutes interview. Her progressive ideals are admirable and needed, but you can't have your focus on the big forest while ignoring the trees.

I dont support Gardner, but KWMU's website says
"If Gardner does not leave office by noon Thursday, Bailey said, he will file a quo warranto action (“by what authority” in Latin. The law gives the attorney general the authority to act “in case any person shall usurp, intrude into or unlawfully hold or execute any office.” A judge would be assigned to the case, and Bailey would argue that Gardner has failed to do her job and is therefore holding office illegally. "

Dont know if this would apply to all states, but if it does, I wonder if States can do the same to sheriffs who refuse to do their duly elected jobs then too ? Like sheriffs are in Illinois.
