The defendant and his accomplice were convicted of murder and sentenced to death. The defendant's lawyer asked for the accomplice's statements, but one statement admitting to the homicide was not given until after the defendant's trial and sentencing. The defendant argued that this violated his right to due process. The Court of Appeals agreed and ordered a retrial for punishment. The issue was whether denying a retrial for guilt as well as punishment violated equal protection.
