Last month, the CDC released an order with a temporary eviction moratorium. Recently Yahoo News released an article claiming that landlords can now evict their tenants if it falls within certain guidelines. The eviction moratorium has put landlords into a very difficult position. Tenants are also in a difficult spot with the massive layoffs and lockdown orders, can't work can't pay right? Well yes, but I have been a huge advocate of landlords working with tenants to come up with solutions, landlords put their financial necks on the line so many people can have a place to live.

In this video, I share a great amount of information about what the CDC eviction moratorium guidelines are but there is still a lot of information about the eviction moratorium that has been overlooked as of recently. You still, as a tenant, can be evicted if you fall within certain provisions in regards to the cdc eviction moratorium guidelines. So can landlords evict tenants with the CDC eviction moratorium? Technically, yes, but there is a good amount of provisions set forth by the CDC eviction moratorium that landlords must abide by.

Now as a tenant applying for the CDC eviction moratorium, there are several categories that you must fall into to be a protected person, but YOU STILL MUST MAKE AN EFFORT TO PAY YOUR RENT! It's not a get out of jail free card with the eviction moratorium. You must make steps to work with your landlord to make partial payments to stay current with your rent. The CDC makes this very clear in their memorandum.

In August I offered my landlord a bunch of United States Postal Service MONEY ORDERS FOR BACK PAYMENT OF RENT.
They refused to accept my rent payments.
I am a retired disabled Navy Veteran and because of the Coronavirus Outbreak the Veterans Hospitals have not been seeing patients face to face. We, I had to go to a hospital that was outside of the Veterans NETWORK and they jacked up the prices for medical treatment and medications.
My lease is RENT WITH OPTION TO BUY. I found a new house and I left.
They tried to sue me. BBut their own lawyer refused to submit the case to the court and they told me that I have an ENFORCEABLE CONTRACT WITH THE OWNERS.
So I got my own lawyer and we are now suing the owners in FEDERAL COURT.
I now have the money to pay the rent. But the owner's husband who is not on the deed is refusing to accept the rent.
But I now have a better option. I played the four numbers of the lottery and won a couple hundred thousand dollars. I am building my house.
My grandfather once said that if something goes bad, it's because GOD has something much more better for me.
And that's exactly what happened.
Now the old house is falling apart since the owners live in the United States.
So I made out like a bandit because I have my new house with more land.
What really happened was that the owners had another buyer who offered them a higher price than what was in the contract for me. You see everyone is afraid of the Coronavirus in the mainland United States so they are coming down here to buy up lots of property. Now I am in contract to buy a farm in Costa Rica that has lots of acres of land. It in the Rain Forest of Costa Rica.
Like my grandfather said GOD DON'T LIKE UGLY...AND THE OWNERS BEHAVIOR WAS EXTREMELY UGLY.

It’s tough for everyone. Why don’t the USA government stop morg. And rent for both sides. To help tent. N landlords. Can’t be that hard

I have a tenant in my two unit property near Buffalo, NY that hasn't paid rent since March. I have reached out to him three times to try to work things out. He has been hostile and rude to my management company. He has about six lease violations. He has been running a car wash out of the driveway and the City has approached him twice to tell him to stop. He has harassed the neighbours. Because of him my upper tenant has moved out so now I have no rental income and I am going deeper into debt. The police have been to the property because he assaulted his daughter in the home. He is also part of a motorcycle gang. My manager has told me that there is not much we can do as the municipal courts are closed and they're afraid that the tenant may retaliate. Right now I am trying to get my lawyer to send a tenant notice as his lease expired last month and he is still living there. But I'm not really getting any support or help. I'm at my wits end and not sure what I can do. Do I have to let him squat there until the moratoriums are finally lifted? That could take another year! Any suggestions?

Most of you will not like this but:

Renters: If you can not afford to pay rent then move out! It makes no sense for you to stay in a place without paying and racking up debt.
Landlords: Screen your prospective tenants better and check all references. If you do not want to do this then do not rent the property or better yet sell it.

We have never owe rent to any landlord. Our recertification is Sept 1, 2020 and I was not told of raising our rent. We never asked for a loan do to covi19. And harrassing a tenant and his family that's not safe. And falsely saying u don't pay. This doesn't make sense.covi 19 did not ask for help. And the landlord it's charging me four months rent I already payed. Why do I have to be responsible to pay something that they want to blame us for extra rent

They have to meet all 5 conditions to be considered a "covered person", not just some of them.

You should make your tenants sign an assignment of any stimulus payments they receive (up to the amount of back due rent).

Question - I have a tenant that pays their rent on time and their contact expires on 12/31. I no longer want to rent out this place and renew their lease. I am hoping they move out with no issue. Should I be concerned. Could they squat after the contact?

If someone was squats in my property I’ll just burn it down while they were in it. That’s what insurance is for. Lol. Pay up!!

CDC has no say in any issue of evictions. It’s unconstitutional. Landlords can evict as normal with the exception of section 8 housing, and homes with government backed loans.

What would u call a landlord that paying ur rent since Jan-Dec 2020 and falsely giving u evictions that u are not paying ur rent. And harrassing u

Check with the judges office where you normally due evictions we are in Texas when I called the judges office they asked If the rental was section 8 or if the mortgage was backed by the federal government. I said no they said the eviction process was the same as before covid 19

CDC eviction moratorium doesn't apply if other jurisdictions that have an eviction moratorium providing the same or greater level of public-health protection than the CDC order. In California Governor Newscum has already declared AB3088 exempts the CDC rules.
