Donald Vale was convicted of possessing heroin and sentenced to 15 years in prison. Vale claimed that the evidence used against him was obtained through an unlawful search and seizure. Officers with warrants for Vale's arrest and information about his location set up surveillance at his residence in an unmarked car. They observed Vale have a brief conversation with the driver of a green Chevrolet and went back inside briefly. The officers approached Vale, who tried to walk away. The driver of the car was seen putting something in his mouth and was immediately arrested. The officers searched Vale's house and found narcotics in a rear bedroom. Vale claimed that the evidence was obtained through an unlawful search and seizure.
