To summarize don't ask the witness to make the conclusion because then they might be able to change the narrative.

I got my Scooby Doo moment last time I was in traffic court! I picked apart the Trooper's pacing technique piece by piece using the way that the road curved and dipped to call into question whether he could maintain an accurate pace while watching his speedometer. I said "So are we to believe that you could maintain X amount of distance from my bumper while negotiating a road that curved right then left while depressing under another freeway AND log your speed?" The officer shrugged and the judge said "I don't think we heard your answer Officer" and I say "I think we know his answer your Honor". Dismissed! I was doing 85 in a 65 at 3 a.m. on my way to work. Your video is helping me again with another traffic citation next month!

Not only Scooby Doo, but also Legally Blonde (1st movie). Elle got a witness to crack under cross-exam and confess that she killed her father. In reality it doesn't work that way. The witness would just stick to her story, and let the jury draw their own conclusions from Elle's theory with perms and showers.

Question, I would think the defense attorney would see that coming and would redirect asking if his client were drunk. How would that affect your submission?

Why are we learning cross from prosecution perspective?? No offense, but prosecutors are notoriously bad at cross, and I say that with first hand experience as a defense attorney. (Ps some of the best lawyers I know are prosecutors, not hate, but building a case is not the same as deconstructing)
