When Should I Hire a Disability Lawyer?

Social Security disability claimants do not need a lawyer to file their initial applications for benefits. In fact, until your case is denied (usually about 3 to 5 months after you apply), there is not all that much a lawyer can do for you.

In my law practice, I rarely get involved in a case prior to the time your initial application for benefits is denied. Once denied, I can help by filing the reconsideration appeal and updating your medical file to improve your chances at an early decision.

Some clients wait until the reconsideration denial before hiring me. If I am retained at this point I will prepare the request for hearing and take on the responsibility for updating the medical record.

I contacted an atty on an initial application, I just asked a few questions. I got a packet in the mail a few days later, this law firm told me that there is nothing they can really do on initial application. I obtained all my records and secured an FCE from my neurologist. They kept calling me for the fee agreement, in case I was approved on initial they would get a decent paycheck for absolutely nothing, I'm in NY. Needless to say I won't use this law firm if I need to appeal. Initial approval approx 39% in NY.

How about other issues like being discriminated against at other places because you have dissablities ( not talking about work place as I can no longer work and was awarded ssi disability without any problems on the first try

I went to social security for my decision 28 years prior They told me my records where so old they were destroyed what kind of bull is this since I'm trying to show the attorney on the other side has committed fraud in my claim no once but several person injuries claims I've had with the same company
