A side note from Australia; in Australia gifts are tax free (even from non family) if they are indeed gifts (i.e. no expectation of anything in return). I was very surprised when I found this out, but it is the law of the land in Australia.

Another quick one to reinforce this. Hollywood stars who receive swag bags i.e. "gift bags" that can exceed $100, 000 are taxable even though there is no explicit agreement between the producers of the merchandise and the Hollywood star. The IRS's position is that these swag bags are NOT being given solely due to respect, admiration and affection (a true gift) BUT with the intent of promotion.

You can extrapolate that and apply it to influencers!!

You can only get away with it if you are on the Supreme Court, in Congress, or in the executive branch of the government. Rules for thee, etc.

not sure if this is something recorded a while ago, but the outro is back to the "for more accurate tax advice...." either way, I agree with what shes saying. a true gift, has no expectation of anything in return....though I would also argue that most people DO get something in return, even if its intangible and unmeasurable in the form of a self proclaimed "atta boy" or feeling of "I'm a good person."

really missed the mark here. companies generally send out PR with no expectation an influencer will even talk about the product. they hope they will but there’s no exchange happening. it’s absolutely a gift intended to butter up influencers so they speak positively on a product or company. influencers often don’t even know what, if, or when they are receiving something. what this person is referring to is a sponsored post which is entirely different. in that situation there are expectations the influencer will deliver something specific in return for actual payment. vivian is basically confusing the two as well but essentially saying “make sure they aren’t expecting a sponsored post” which tbh its usually very clear whether a company is expecting that.
