When you file a motion for USCIS to reopen or reconsider your case, there is no deadline for USCIS and the case is often ignored after that.

Instead of doing a motion to reopen or reconsider, you could file a new application or sue in federal court.

Our I-129F case was denied because the letter USCIS sent to my fiance was delivered to a wrong address. So we were denied on the 7th of August 2019, we applied to Motion to Reopen and provided evidence that the wrong person actually received it instead of us. Our case was reopened on the 5th of March 2020, and 3 days later our case was approved. Now waiting for an NVC letter...

I know someone close, who had a very complicated issue, his case was denied. In his case motion to reopen/reconsider approved.

This is my case now :

The US court of Appeals for the second circuit has requested that the board of immigration appeal reconsider its decision in deciding whether or not to reopen your case.
I don’t know if they will reopen or not

Thank you sir, one very informative video. I have filed a motion to reconsider and fortunately got approved. However it was indeed taking a long time to get a response so I made an inquiry to why my case is taking so long and finally got a response after a year. So, when Jim says you might want to consider reapplying from the very beginning he’s not kidding you. Thank you for your honesty and for your work.

While what you say is true, attorneys often use motions to reopen / reconsider to make a record. For example, say the EAD was denied while awaiting an I-130 interview. I would advise a client to file a motion to reconsider on the EAD to make a record for the I-130 interview.

What happened when you file for asylum, let’s say January 2023. They they say in August 2023, asylum office administratively closed your case because of lack of jurisdiction.

It further says, if in applicant is in proceedings with EOIR, they should RE-FILE i-589 with immigration court. Im confused, i thought once you file with USCIS, they then send it to EOIR when they’re done.

They claim they denied my EAD because records check indicates no pending Asylum with immigration court.

But I can log on to EOIR WEBSITE and see my case pending.Am i missing something? Why they say Re-file, and DENIED EAD

Hello, my brother miss the court day because he moved to a different address and the moved the day for court, he went to the apoiment 2 days later and the let him know he has deportation letter, and they told him to appeal within 30 days,
*how he can do the motion to reopen?

Hi Sir, my case motion was approved on 2 March 2021 by email and today 8 March 2021 I got mail and the letter said motion will be denial. Its stressful for us had awaiting so long 15 months what wrong uscis. And what we can do the next please

My form N400 was denied. And then I got a final decision that it was denied....but after 2 weeks I got in the mail a receipt notice says that I paid $725 ((for the application that was denied)) and also it says that they're going to send me a biometric appointment for my form N400 application..the date of the notice is 2 weeks after I already did the naturalization interview and I got denied...how's that even possible ?? I go to my online account and the last thing is saying that my form N400 is denied. Did USCIS reopened my application without me even asking ? Or what exactly ?

Should I use the original date of the application or the date the case was reopened for priority date for a visa? Our original date of application is 2010 but the reopened date was 2015. Thank you for the answer.

I do not wanna apply for motion to reopen, but I want to apply for a visitor visa for a short term visit. Because the petition got denied previously, will it impact getting a tourist visa?

Hello, we filed i290b 2 months ago but they still haven’t taken the fee for the i290b application. Is it normal? Or normally they take the fee once they recieved it?
