We have Mr. Magoo back in front of Judge Simpson. This is the sovereign citizen that has caused a bit of a mess and a lot of frustration in this court. He is also the sovcit that said he, "overstands" what is going on. That is one of the many games he has decided to play. Today there was a quick hearing and this is just the final update before the prelim exam on the 21st. Enjoy!

Isn't YouTube so effective in warning the world that Maggo is off his trolley? Has he no family members who might remind him that generations of people around the world are going to use him as a unit of lunacy. 'He went the full dozen Magoos today, the judge gave him the max.'

I agree with some of the commenters about his request for officers at his prelim. They are not usually present at this stage, unless there is a defense that involves impeaching one or more of the officers. They will be questioned on the facts of the case at trial, so it's hard to know what this legal illiterate is planning, other than being a nuisance. It is likely that he thinks that he can try his case at the hearing, because the mean old cops did something that he didn't like, which the judge will not permit, so this could be a short hearing.

It became a motion hearing because of his motion to which the state has replied that they will request an adjournment to prepare the officers.

If I recall correctly, at the last hearing Judge Simpson said they'd do a motion hearing today in addition to the preliminary exam. But also, normally a preliminary exam wouldn't need the officer(s) involved - if the defense council wants to question the officers that's what the trial is for. I think Judge Simpson is just pushing the preliminary exam and having the officers come in to box out something MaGoo would otherwise bitch about at trial or use as grounds for an appeal that an actual attorney simply wouldn't waste court time with. Remember that MaGoo had also so far neither waived a preliminary exam nor said he wanted one because he seems to think that unless he's presented with what HE deems to be conviction-worthy evidence upon being arraigned that he shouldn't have been charged at all.

Normally the prosecutor would just present enough facts of the case to convince Judge Simpson that there's enough confidence to say Magoo did the crime that there's a reason to take it to trial - where THEN they would have to prove that beyond a reasonable doubt. They don't usually have much, if any, witness testimony and cross-examination in court before the actual trial.

Judge Simpson got MaGoo to not just agree to HAVE the preliminary exam but also that the ONLY two outstanding issues he was asking for in any and every motions he submitted by the motion date is that the officer(s) involved be at the preliminary exam (granted) and that his very standard bond conditions be removed because it's so very unfair to have pre-trial bond convictions without having first been convicted at trial (denied). And that now those two issues are ruled upon, there's nothing else he feels he needs to have addressed.

Now on the 21st Judge Simpson has everything on the record he needs to deny any further attempts Magoo might make to delay or derail the trial, while also making an issue that would have been nonsense in an appeal but would have still taken more court time to hear argument on the merits into an issue that the appeal judge can simply say "you wanted a preliminary examination and for the officers to be at the preliminary examination, the record shows you got exactly what you asked for. Denied."

Thanks for staying on top of this. Please circle the date of his next hearing. Mr. Magoo is absolutely must-see TV. As is Eric Martin. His next court date is soon I believe. January is starting off with a bang!

I am not convinced he is a SovCit. He more strikes me as a frauditor at this point due to the charges, how bad he wanted the bodycam footage suppressed, and now how much he demands having the cops there to question.

You don’t depose witnesses in court. You depose them in private in front of a court reporter and opposing counsel. That’s how you figure out whether you want to use them as a witness or not.

The judge probably isn't going to hold the prelim exam until he is satisfied discovery is complete. Since both the prosecution & defense agreed discovery is not complete, there was no reason for the judge to hold the prelim exam. Since the prelim exam was not actually held, he would not dismiss the case for lack of probable cause due to the witnesses (the LEOs) not being present.
