4. Plaintiff/Petitioner John Doe (hereinafter “Plaintiff”) has lived in Baldwin County, Alabama since birth.
5. Defendant James Smith (hereinafter “Smith”) at all times relevant to the facts herein was a police officer employed by the City of Foley.
6. Smith is sued in his private capacity.
