Evicting a bad tenant is not fun for both the landlord and a tenant. It's something that landlords, unfortunately, have to deal with when it comes to our property management process. However, there IS a way of handling the eviction process ethically, legally, and stress-free. Each state has its own landlord-tenant laws as well as some cities like Chicago, NYC, and even Los Angeles.

The key to your landlord's success is to have an airtight property management process. One of the biggest property management tips in removing a bad tenant is to stay calm and never let your emotions take over. You can easily let your emotions take over if your tenant is obviously expressing their anger and frustration. But in any property management process, you must stay calm and make certain decisions ahead time with a policy. Same thing with removing a bad tenant or the eviction process. You must have a policy in place that you created BEFORE you go through an eviction process with a bad tenant.

I've been landlording since I was 21. I realized a few years into renting property by charging move in fees, etc instead of a security deposit, It helps my profitability/bottomline and it avoids the headaches of the tenant fighting you for it back. I would still have them sign a property condition checklist (which is required in my state whenever a deposit is taken).

As a landlord/manager for 27 years, I was not impressed with this attorney, and he gave some really bad advice, saying to just "put the 3 day notice on their door". You must also send it regular AND certified mail, else it's invalid. Also to charge a non-refundable move-in fee., is that even legal?

In Oregon, "move in fees" are prohibited. In fact, most "fees" are not allowed anymore. We have only the security deposit to rely on.

I live in the same house and rent out my rooms. I have keys to all the doors but sometimes they change the locks, install an alarm and won't let me in. But usually I can let the sheriff in for an eviction.

Quick question I inherited tenants from a good tenant who’s lease just ended but they failed to tell me they had a sub tenant. Can I make require them to fill out a rental application? They have been living at my rental and have paid on time never late. Apartment is spotless, I have a feeling they have low credit and want to avoid being denied. They insist they don’t have to and want to continue paying rent. In California. Do I have any protections?

How can a regular property manager like me, work towards getting landlord tenant laws changed regarding illegal residents? What are the steps ? Who do I talk to 1st? Security deposits are there for damages when they move out. This lawyer obviously hasn't had to get a rental unit ready after the home has been trashed & no money for repairs. I have a guy who moved in along with 4 others w/ a true legal resident & has been threatening towards the resident & myself & running prostitution & drugs out of the unit. Cops don't have enough yet for an arrest. Laws must change! He is doing this because he knows he can! If I find illegal residents, I should be able to have him removed . Been doing this 20 years & property managers always get the short end of the stick. I'm so over it!! Please respond if you know where I can start & I know it will be tough.

Thanks for this. I just got my first property last year and the first tenant has been short on rent last 3 months in a row. I wanted to do some reading and watch some videos first before I go through with having my property manager send them a N4. This makes me feel better about the process. :)

If you have someone who knows tenant law better than the landlord, it is because he has done it before and there is a record of the evictions. The landlord did not do his due diligence in the pre-screening of potential tenants.

Please help anyone. My dad died, and I'm severely disabled as I suffered a traumatic brain injury in 1993 and my family doesn't seem to care that I can't just move and my brother had me sign a rental agreement but my brother who is executor keeps telling me that he signed an auction agreement with kiko I currently am homebound bue to my disability my dad who included me as a beneficiary was the only help I had, please help

I agree with him in most of the things. I'm a landlord and understand everything he said. I've been there before. But as a homeowner sometimes you have to stain the tenant record and credit to prevent that tenant to keep moving foward scamming somebody else. It is easier to do a background check and see what the tenant did before and disqualify him or her than go through the whole headache.
