That is ridiculous. Basically that means that in order to "remain silent" you have to break your silence by speaking up.

The Miranda warning I hear on TV shows asks if you understand these rights. I don't hear cops asking if a person wishes to invoke those rights. How can it be a right if you have to assert it?

Always remember the cops work FOR THE STATE, not for you. They are not there for your safety and protection, but as the physical implementation of the rules the state determined you will abide by. REMEMBER, those that give you rights always give themselves exemptions.

Is this only for the fifth amendment or for all of them? Do I have to recite the Constitution or can I just make a blanket statement that I'm invoking my constitutional rights?

Assert your 5th, then tell them you'll answer questions in the presence of and on the advice of your lawyer. Now you're cooperating. OFC any lawyer will tell you not to answer their questions.

So what does “You have the
R-I-G-H-T to remain silent” actually mean then. If it’s ALREADY a “right” why would I have to speak to invoke my right to remain silent? It’s ludicrous.

ABSURD! You DO NOT have to verbalize intent to use rights in order to "activate" rights. Rhats not how inalienable rights work!

This sounds like a loophole that's going to be abused against anyone that doesn't speak confidently. That the Police can say he never Declared His Fifth Amendment Rights... Because everytime he tried I kept interrupting him saying 'That's Not what I wanna hear! I know! I know! But unless you start talking you're gonna be in big trouble!', "I invoke...", "I TOLD YOU I KNOW!!! Stop whining about that and answer the damn questions!!!'

At Trial, "He never once fully declared his desire to maintain his silence under the Fifth Amendment, as such I believer he was staying silent under questionable or guilt-ridden circumstances."
