I'm not going to lie... watching you have a visceral emotional reaction as you continued reading this motion was one of the most entertaining things I've seen thus far.

You have had great coverage that I have enjoyed - I can always count on you to get down to the actual law... these people are pretty bad though, they lost me a *long time ago in this process.

Hold up there a sec, chief. They're making an argument that it can't be IIED because it wouldn't be an intentional harm if they believed she had CRPS, which violates not only their stated beliefs but largely the underlying premise for performing the test, i.e. that they believed she didn't have CRPS. It's even bad as an argument in the alternative, because accepting it has negative knock-on effects on their other arguments!

So Kurt, I know you didn't watch the whole trial. Hear me out. If you see this comment.

Myay had been to JHACH mulitiple times, before and after the CRPS diagnosis. They ran tests, the other Hospital ran tests, they tried physical therapy, for at least 6 months, they tried other drugs, Maya was still deteriorating in condition. Then JHACH put in the infusion port prior to her going down to Mexico for the Ketamine Coma, and they knew she was going down there for it. Did they have a right to say, maybe the Ketamine isn't working yes, but did they have a rigth to ignore CRPS as the diagnoses, when they had been intimately involved in the medical history of Maya....I would say no. They knew that the family was struggling with a cronically ill child. Did they have the right to call in DCF, probably, but DCF said you don't have enough evidence, soe Sallty Smith decided to proove it. If you look hard enough for something you will find it. Also JHACH was in the dependancy courts as an active paticipate (Hunter) argueing against the family being given costudy of Maya to ntake to an Orlando CRPS specialist who didn't use drugs. They wanted to send her out of state (Ohio) to further seperate her from her parents. They went out of their way to interfere with the family, of whom the Father was held Blameless. They denied Beata the court autherized 2 video calls a day the last 3 weeks, they played games with hidee the Maya when her father called 2 hours ahead to schedule visits, stuff that was not required by the court after November. Read the dependancey court orders that were read into the record. It was sometime near the end of the defense case.

I'm so happy that either there were so few trolls in this stream, and that you're getting much better about not letting them get under your skin (an instance or two very late in the game, but quickly recovered from). This episode ran so long, and was a delight the whole time

Plantiffs never got the IJ document - which was the JCAHO (Joint Commission) report.
They had a copy of the CMS (Center for Medicare & Medicaid) report which was the one that was in the Tampa Bay paper.

The order exist because SS made sure of it. I can accept the first call to DCF but once the hospital got the information about Maya from her doctors they didn’t have a right to keep calling DCF until they opened a case. Just my opinion. Watching on replay.

The defendant wanted to keep out all of the chapter 39 stuff. Because they're shielded by chapter 39. But they also wanted to bring in all the dependency filings against the family to use against the plaintiff and the judge kept that out.

Here me out: these lawyers have Munchhausen‘s by proxy. They are hell-bent on their own reputational annihilation- keeping this awful tragedy and their responsibility in the news. The repetitional damage of this has been a total loss of confidence in an institution that only a year ago had one of the most prominent reputations in the country. Yes, I feel bad for Maya, but my god, man, when are they going to try and pick up the pieces of their selves and the institution and find what is salvageable.

@Uncivil, i love the analytical view you provide... We can get the emotional view nearly anywhere ( leaning one way or another) but a truely 'law-only' view is what we need to parse through how these motions will be viewed... BUT.. we will need this view based only on the Court transcripts and filed morions/responses..
A lot of what we watched..the jury did not see.
