Another extract from our up and coming IFR procedures App (Probable Release date 06/01/2015). This time we focus on something most pilots forget to take into consideration. FAR 91.175 doesn't always apply to non commercial pilots. Visit:
and let us help you become a better and safer pilot.

From the Instrument Procedures Handbook.

ODPs are not assigned by ATC unless absolutely necessary
to achieve aircraft separation. It is the pilot’s responsibility
to determine if there is an ODP published for that airport. If a
Part 91 pilot is not given a clearance containing an ODP, SID,
or radar vectors and an ODP exists, compliance with such
a procedure is the pilot’s choice.

ZME controller here - what is the "std." listed after the 400-2 or std. I assume Standard (which would be 1 mi 2 engines or less and .5 mi 3 engines or more) but I have no clue.

Thanks

Ok please someone answer me

So if I can’t comply with the climb gradient, the visibility and ceiling must be greater than that for me to go “legal”? Even thou I can’t climb more than what they are asking me??

Pretend RWY 23 only lists “standard”. Can I take off and fly the SID 0-0?

Can you show the FAA regulations were you found that information?  Based on what I am reading for part 91 their are no takeoff minimums.  Even if a departure procedure is published a part 91 operator doesn't have to follow it.  91.175 part (f) states that everything in that section only applies to 121, 125, 129, or 135 of this chapter.  Then (1) goes on to talk about what you are talking about weather minimums prescribed for that airport.  It does not say anything about it applying to part 91.  I am not saying I would not take a look at the minimums prescribed but not sure they apply to part 91.
