Omni is actually right. What these folks are doing is absolutely no different than what data brokers do through apps and websites. He can show his hilarious lack of profits from operating the site as a criminal defense to that. Did you know somebody is selling Grindr dating app data? Why isn't that illegal, all because you had a lawyer write up a 50 page EULA (end user licensing agreement) that everybody scrolls through and in tiny print authorizes the sale of your info?

Breached forum (the sequel) has faced a somewhat similar fate. The login page wasn't a honey pot or phising scheme at least.

Of the world's common-law jurisdictions, the US federal criminal system (where Omni is charged) is unusual with criminal sentencing. There is a highly elaborate, and controversial, set of rules known as the "sentencing guidelines." If a defendant is convicted (remember: he hasn't been convicted yet), then the court _must_ use the factors and numbers in the guidelines to _calculate_ the "guideline" punishment for the defendant. There are huge legal problems here, but that's not my point.

If you want to know if a US court would "mitigate" a potential sentence against Omni due to his age, it's unusually easy to find out: just look in the sentencing guidelines.

9:45 Any company calling themselves, or having themselves advertised as, "world's number one x" is immediately sus. Other companies with more sense to not open themselves to false-advertisement accusations at least have the "creativity" to use the utterly meaningless, semantically nonsensical, legally unimpugnable, and therefore perfectly marketing-lingo-suitable phrase "a leader".

If omni started and stoped the site while he was underage, I would think that he shouldn't really be punished a lot, but since he just continues to now when he is 21 i think he should be held responsible, but mostly for what he did after he turned 18.

From the looks of this story the raid owner took essential 0 steps to cover his ass. Probably because he didn't initially plan for the site to go the direction it did, than when it did he just kind of shrugged and said "Welp that happened". The crazy thing (i may have missed something though) is how long it took Investigative Agencies to take down a black-market site with 0 op-sec run by 1 guy. Now imagine an actual organized group, how long would it take?

Yes he made RF when he was 14 and it wasn’t originally intended to sell illegal information, but when it did he had the chance to shut down the service. if he had shut down the service before he became a legal adult then the charges should be as if he was a child, but he didn’t so he should be changed as an adult all the way.

When I was 14 I was able to create my own forums websites using phpbb, or vbulletin, simple machines forums, etc... Each have easy to follow documents on how to create your own forum's websites. It's no surprise someone at that age could make a forum website. Before social media, online forums where the place to be.

Facebook IS different. Meta captures all of your friends and family, then says "if you want to connect with your friends and family, we'll just need all of your personal data." Sure, anyone can delete their account whenever they like, but when the rest of the world is online, you're only segregating yourself from what has become the hive mind. They know this and that's why they are worse. You want to be part of the future? Just check this box, so I can sell your personal information to the highest bidder.

I don't really care for the idea of US law enforcement pursuing someone in a foreign country. It would seem to be a stretch to believe that any of his crimes were actually committed in the US.

It's unlikely they'll do anything to actually stop the criminals hurting US citizens so they settle for whatever nitwit they were able to take down.

Now I'm kinda wondering what happens to domains once they're seized.. are they just held indefinitely or just released after x years? How do the government even seize them as well :/
