The throat of a whale is around the size of a grapefruit in diameter. They physically cannot swallow anything larger than that. The whale could die from choking on a person (not by suffocating, but from its throat being blocked and therefore preventing it from eating) so the whale is probably just as freaked out when it accidentally grabs a human as the human is lol.
