This makes about as much sense as saying that people who obey the speed limit are exploiting a loophole to avoid paying traffic tickets.

The people you are quoting are congress members, like the ones who wrote this tariff law 90 years ago, and are in fact the ones who can change this law right now. They could set the limit anywhere from $0 to $799 and eliminate this 'loophole' that people are 'exploiting' by complying with exactly how it is written.

So why aren't they doing that? Would it be massively unpopular if peoples Temu orders suddenly cost more? Thus the attempt to spin obeying the law as nefarious? Personally I think they can't lower the de mininus rule to say $100, without a massive expenditure on the customs inspection side, which is a waste of money. Maybe it's an attempt to get Chinese retailers like this to bulk ship and then either set up a US side to their operation or deal with a US disttibutor.

The whole thing stinks of pressure from US retailers for them to do something about Chinese retailers. It probably won't be long until we are just directly subsidizing Amazon.
