Foss Patents: The CMA vs Microsoft Appeal Hearing Was Brutal

The Microsoft CMA appeal hearing took place yesterday and Foss Patents had a play-by-play of the event. Microsoft and Activision were both in attendance and the CMA tried to delay the hearing while the judge and Microsoft + Activision seemed to make them squirm. The Microsoft Activision merger was blocked by the CMA recently as another location approved the merger without conditions. 39 Countries have now approved with the CMA and FTC outliers in terms of the decision.

As the appeal of the block is about to head to trial, many have discussed the CMA Microsoft Activision Deal and how this could be an issue for the tribunal. In addition, we look at the arguments from Microsoft about the merger.

The CMA reacted to the EU Approving the Microsoft Activision Deal and it would seem that they are sticking to their original findings in the case. The CMA has received a lot of criticism for its decision to block the Microsoft Activision deal over cloud gaming concerns, and that includes the EU. While the EU agreed about the cloud gaming concerns, they completely disagree about the remedies offered by Microsoft, going so far as to say that it will promote competition instead of harm it. In addition, the CMA response we also get to hear from Microsoft and Activision about their stance on the matter.

I get Sony wanting to have this deal blocked because they have their own business interests and priorities. But the CMA has no excuses to be this unprofessional.

What I like about Florian is that he's an experienced analyst that has years of dealing in these matters. He rarely talks to the 'games' side of this if you know what I mean (no fanboy, console war nonsense with him). Keeps it purely on the facts, arguments and legalities of this situation.

I find it so odd that the deal is being held up because MS invested into a new technology and Sony didn't. Imagine if Sony intended to buy another game developer that made VR games, could MS then try to block it because MS doesn't have VR games?

I think the most damning part of the CMA decision was that they didn't want to have to oversee MS adherence to any restrictions/remedies they would've imposed, so they chose to block it, instead; I don't think laziness is a good defense for the CMA.
