The IRS does not arrest people for not filing a tax return. They first send a letter. Then another letter. And another and another. They send enough letters to fill a box. The letters say, essentially, "we noticed you haven't filed your return, but we know you have income because we got the W2s and 1099's that were sent by your employer and/or banks or whatever. Please file your return."

Source: my father was an IRS agent for years, quit to start his tax accounting business. I worked with him for nearly 40 years. Seen it all.

As long as you don’t owe money. I waited 3 years to file once. Nothing happened. They still gave me a refund.

If you’re due a refund (and the IRS can tell), they are very patient when it comes to filing.

I knew a guy who never bought a house, never owned a car for long (he would buy and sell used vehicles) and who worked at a job as a consultant with multiple other companies where he was paid checks that he cashed out on the day he got them. He told me he always filed his taxes but never paid any federal income tax, ever. He also had connections with a man in the Asian community in town who acted as an unregistered bank and held his cash for him for a fee. After several decades of working like this he retired and is now living in Hawaii under an alias.
He was never prosecuted or charged with a crime since the collection of back taxes is a civil, not a criminal manner as long as you file your taxes.

I was told by a tax professional that I didn't need to file one year because I made less than $3000 that year

The fact that our tax system and judicial system are so overwhelmingly complicated that you need specialists and attorneys to help you figure it all out is absolutely ridiculous to me. You shouldn’t need a Masters or PhD to understand taxes.

I file every four years, and have for the last 20 years. I typically get a series of DD's from the IRS for the money I so graciously lent them for those four years when I file all four years' previous returns at once.

We're not supposed to be paying taxes period. This was used during WWII, then the government supposed to had done away with it, but since it generated so much revenue this is where we are today.

Really not sure why we pay the taxes we do anymore. With all the money printed 4 years ago. Personal income tax was supposed to be temporary anyways.

An American friend of mine worked in Japan as an English for more than 5 years and she did file taxes even though she didn't have to pay taxes because at that time Americans who worked overseas didn't have to pay taxes if they made less than $97, 000. However, she met many Americans who never filed taxes because they believed the IRS will not waste their resources to jail Americans who made little to nothing overseas.

I know two guys who didn't file for years. I mean like 20+ years. One guy worked full time, so taxes were taken out of his paychecks, but he never filed a return (so out of state child support wouldn't find him). But the IRS didn't care because they got his money. He finally files years of back returns, and then had to start paying back support. The other guy lived at home, and never made much, so never filed.
But my question is, I thought filing a return was voluntary, but you just couldn't avoid paying in. I mean what do they do with homeless people. Arrest them for not filing?

There are millions of non filers who should file - not enough federal prison cells to hold that many, not even close. Not to mention they don't have the legal resources to handle that many cases. So, they go after low hanging fruits, especially celebrities like Richard Hatch, Leona Helmsley or Wesley Snipes or those who are publicly outspoken. They also go after very high income earners that should file too.

Filing a timely Form 1040 in response to information return(s) already sent to the IRS constitutes a lawful claim for refund under the provisions of 26 U.S.C. § 6402. However, if our federal government was not a party to your economic transactions for the Tax Year, you can file correcting form 4852 and include it instead of the erroneous Form W-2 and obtain a complete refund of all withheld amounts, including withheld FIT, Medicare and FICA contributions.

I have a friend that was making over $100, 000 a year and hasn't filed in over 45 years. Never received one notice from the IRS
