Me : Better Call Saul is fun but not so realistic...

Mike Rafi : Hold my vest

Folks. He's basically just trying to underline the fact that an MRI is not done in a normal sleeping position. So just because something looks good on an MRI, doesn't mean there's not an issue, especially when you toss and turn at night. And the doctor *only* looked at the medical records like the MRI. He was trying to prove that just because you look at the records, doesn't mean you know everything.

They told him he couldn’t lie on the stand so he used the floor instead. 💪

Mike may correct me. I believe the point is that if Mike had merely asked whether the doctor had only reviewed the record, it would have been deflected out of hand, and opposing counsel would have reinforced the legitimacy of that kind of review.

Doing this made the question of the doctor only reviewing the record more memorable and important because of of the jury's active involvement.

I’ve always said that in order to be a good attorney requires you to also be a good actor.

Just so we're clear, my like is directed at that beautiful golden doodle, I mean Mike is interesting, but it just didn't occur to me to like until I saw that gorgeous canine

Gotta get the jury paying attention when you're getting to the important bits.

NO doctor that has not personnally diagnosed / treated the patient should ever be able to overrrule any doctor that has not so, not insurance doctor, not doctor in court, not doctor employed by state or any social security organisation.

Co-counsel didn't wake up that morning anticipating hearing: "I'm gonna lay down on the ground."

Rafi may be a good lawyer, but co-counsel is a good boy.

I have POTS and thought he'd had some sort of light headed or dizzy episode then it went in a very different direction (obviously) and I remembered most people don't have to lay down in really inconvenient places lol

What a great way to engage the jury.

Dynamic MRIs exist for a reason. But well done on illustrating why.

wonder how sleep is related to that line of questioning, just because how goddamn loud an MRI machine gets. It can go well over 100dB.

I was just denied for my disability a second time.
They said that I didn't send in records and based on the information they had I'm not disabled.
Every time I've gotten an MRI over the last 3½yrs, it's come back slightly worse.
I have limited functionality and mobility on my left side, I can't do most jobs because I can't lift or carry weight, I can't sit or stand longer than 20min, I'm constantly fatigued which is compounded by all the pain meds including opioids I'm on.
My doctor diagnosed me with 25 spinal cord issues, more than half of which are covered by social security.
And the social security doctor they sent me to was a damn joke.
All he did was test my diminished hand strength, watched me walk for a few steps, and talked about the power of positive healing.
Damn bloody joke trying to get help in Texas.

So interesting. He knows how to get the jury's attention. And that's gotta count for something. 😅
