what if the treating surgeon has had to do 11 emergency surgeries to fix all the problems and in the notes he is outright saying it was the other surgeons fault ?

Nope I would definitely not tell another Doctor about my case. He would use that against me later.

Lawsuit is mysterious and complicated to general people. Do not let people know you are in court. Because it could make things more complicated negatively.
